1.4.1 RIGHTS
Foreigner with regular residence permit may ask for family reuniting with the following family members:
- not legally divorced spouse;
- minor age children, either of spouse or born out of wedlock (only if other parent gives consent); adopted or entrusted children;
- dependent parents, if they have no other son or daughter in the country of origin or for serious and documented health problems if parents are more than 65 years old.
To obtain family reuniting foreigner present in Italy must prove:
- availability of accommodation;
- availability of yearly income, derived from legal sources, not less than amount established by law. This amount rises in proportion to number of people that are to be called into Italy.
Entry is allowed for reuniting the natural parent of a minor child residing in Italy, and who proves, within 1 year, the availability of income and accommodation above mentioned.
NOTE WELL The residence permit obtained for family reuniting can be converted in a permit for subordinate employment, for self employment or for studies if the relative who obtained the family reuniting dies, or in case of legal separation.

1.4.2 HOW TO OBTAIN IT
NECESSARY DOCUMENTS
A permit request for family reuniting must be presented to the Unique Door for Immigration , by the Prefettura (Government territorial offices) of the place in which the foreigner lives while family members with whom applicant wants reuniting are still abroad. With this request must be enclosed:
- photocopy of residence permit;
- residence certificate and photocopy;
- declaration of employer that certifies that employment is of continuative type, indicating monthly average wage and last three pay scripts, all original and in photocopies;
- photocopy of the CUD or 730 form; in case of self employed worker a copy of the Unico form, a certificate of the registration in the Commerce Chamber and the IVA registration where required;
- rent contract regularly registered or property title of accommodation of residence; a certificate proving the legal availability of each accommodation - which can be obtained by the ASL or by the Comuni - must be presented
- two photocopies of passport of family member/s of which reuniting is requested;
- if request concerns spouse, wedding certificate must be presented; if it concerns other family members a certificate proving the familiar degree must be presented. All of these documents must have be translated in Italian by the Italian Embassy abroad.
This permit has the same duration of the permit of the relative who obtained the family reuniting.
USEFUL INFORMATION
- The procedure for the issue of a family reuniting generally lasts three months. If the Police Headquarters issues its permit to the reuniting, the foreigner may obtain an entry visa for his family members at the Italian Embassy or Consulate. This permit must be utilised within six months.
- If Police Headquarters does not issue its permit to reunite family, the foreigner may appeal to the Judge of his place of residence. The Judge, on hearing the person concerned, takes action with a decree. The decree of the Judge who accepts the appeal may decide to issue a visa also in absence of the permit.
- All deeds of this proceeding are stamp duty and register exempt.
- Whoever offers an accommodation to a foreigner must communicate it to the police headquarters. The communication must enclose the passport references of the foreigner and the address of the accommodation, as the reasons for its use by the foreigner. Every violation of this principle will be punished with an administrative bill from € 160 to € 1000.
